These Terms of Service (“Terms”) govern your access to and use of the website, services, communications, and offerings provided by Domaine Concierge LLC (“Company,” “we,” “our,” or “us”).

By accessing our website, engaging our services, submitting a service request, or otherwise interacting with Domaine Concierge LLC, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must discontinue use of our services immediately.

1. Company Overview

Domaine Concierge LLC is a Florida-based property and lifestyle concierge company that provides personalized assistance, property coordination, and lifestyle support services.

Our services may include, but are not limited to:

  • Personal concierge services

  • Lifestyle management

  • Household coordination

  • Vendor scheduling and oversight

  • Property monitoring coordination

  • Personal errands and assistance

  • Event coordination assistance

  • Travel planning assistance

  • Administrative and logistical support

  • Luxury lifestyle services and sourcing

All services are performed on a best-effort basis and subject to availability, scheduling, and client cooperation.

2. Independent Contractor Status

Domaine Concierge LLC operates as an independent contractor.

Nothing in these Terms shall be interpreted to create:

  • A partnership

  • Joint venture

  • Employer–employee relationship

  • Agency relationship beyond limited coordination services

The Company provides independent concierge coordination services only.

Clients acknowledge that:

  • Domaine Concierge LLC is not an employee, agent, or representative of the client

  • The Company retains control over how services are performed

  • Services are provided at the Company's discretion within the agreed scope

3. Scope of Services

Services are customized and may vary depending on client needs.

The Company may:

  • Coordinate services

  • Research and recommend vendors

  • Assist with scheduling

  • Provide logistical support

However, the Company does not guarantee outcomes, availability, or vendor performance.

We reserve the right to:

  • Decline service requests

  • Modify service scope

  • Refuse services that may be illegal, unsafe, unethical, or outside our expertise.

4. Client Responsibilities

Clients agree to:

  • Provide accurate information

  • Communicate requests clearly

  • Provide necessary authorizations and access

  • Maintain respectful communication with staff and vendors

  • Comply with all applicable laws

Clients are solely responsible for decisions made regarding vendors, purchases, bookings, and services coordinated through the Company.

5. Pricing and Payment

Service pricing may include:

  • Hourly service rates

  • Monthly concierge retainers

  • Project-based pricing

  • Vendor coordination fees

  • Administrative service fees

Clients may also be responsible for:

  • Vendor deposits

  • Travel expenses

  • Purchases made on behalf of the client

  • Service fees from third parties

Payment terms may include:

  • Advance payment

  • Retainers

  • Prepaid service packages

  • Billing upon completion

All invoices must be paid within the timeframe stated.

Failure to pay may result in:

  • Service suspension

  • Late fees

  • Collections action

  • Legal enforcement

All payments are non-refundable unless otherwise agreed in writing.

6. Chargebacks and Payment Disputes

Clients agree not to initiate chargebacks or payment disputes with their financial institution without first contacting Domaine Concierge LLC to attempt resolution.

Improper chargebacks may result in:

  • Immediate termination of services

  • Legal recovery of disputed funds

  • Additional administrative and legal costs

The Company reserves the right to pursue recovery of unpaid balances.

7. Vendor Liability Disclaimer

As part of concierge services, Domaine Concierge LLC may recommend, coordinate, or refer third-party vendors, contractors, service providers, travel providers, or professionals.

Clients acknowledge and agree that:

  • These vendors are independent third parties

  • Domaine Concierge LLC does not own, control, employ, or manage these vendors

  • Vendor agreements are strictly between the client and the vendor

Therefore, Domaine Concierge LLC shall not be liable for:

  • Vendor performance

  • Service quality

  • Scheduling delays

  • Property damage

  • Personal injury

  • Contract disputes

  • Vendor negligence

Clients assume all risks associated with engaging third-party providers.

The Company’s role is coordination and facilitation only.

Vendor Referral Disclaimer

Domaine Concierge LLC may, from time to time, recommend or refer third-party vendors, contractors, service providers, professionals, or suppliers (“Vendors”) to clients as part of its concierge and coordination services.

All such referrals are provided solely as a convenience to clients.

Clients acknowledge and agree that:

  • Domaine Concierge LLC does not own, operate, employ, manage, supervise, or control any third-party vendors.

  • Vendors operate as independent businesses and are solely responsible for their services, pricing, conduct, and performance.

  • Any agreements entered into between the client and a vendor are strictly between the client and the vendor.

Domaine Concierge LLC does not guarantee:

  • Vendor availability

  • Service quality

  • Workmanship

  • Licensing status

  • Insurance coverage

  • Professional qualifications

  • Timelines or project outcomes

Clients are responsible for conducting their own due diligence prior to engaging any vendor.

To the fullest extent permitted by law, Domaine Concierge LLC shall not be liable for any loss, damage, injury, delays, or disputes arising from or related to services provided by third-party vendors, even if such vendors were recommended or coordinated by the Company.

The Company's role is strictly limited to facilitation, scheduling assistance, and coordination when requested by the client.

Non-Circumvention of Vendors

Clients acknowledge that Domaine Concierge LLC has invested significant time, effort, industry expertise, and business resources in identifying, vetting, and establishing relationships with trusted vendors and service providers.

Accordingly, clients agree that they shall not directly or indirectly circumvent, bypass, or avoid Domaine Concierge LLC in order to engage vendors introduced or referred by the Company.

This includes, but is not limited to:

  • Hiring vendors directly after introduction by Domaine Concierge LLC without the Company's involvement

  • Attempting to negotiate services directly with vendors initially introduced through the Company

  • Using vendor contact information obtained through the Company to bypass concierge services

  • Encouraging vendors to provide services outside of the Company's coordination

If a client engages a vendor introduced by Domaine Concierge LLC outside of the Company's services within twenty-four (24) months of the introduction, the Company reserves the right to charge a referral fee, placement fee, or service fee equivalent to the standard concierge coordination rate or vendor referral fee.

This provision is intended to protect the Company's proprietary vendor network and professional relationships.

Violation of this clause may result in:

  • Immediate termination of services

  • Legal action for damages

  • Recovery of lost service fees

  • Additional legal costs and enforcement fees

Vendor contact information, pricing structures, and referral relationships maintained by Domaine Concierge LLC constitute proprietary business information and trade relationships.

8. Purchases Made on Client's Behalf

From time to time, the Company may purchase goods or services on behalf of the client.

Clients agree that:

  • All purchases are made as a convenience service

  • Clients are responsible for reimbursement

  • The Company is not responsible for manufacturer defects, warranties, or product issues.

All disputes regarding products or services must be addressed with the original vendor.

9. Confidentiality

Domaine Concierge LLC understands that many concierge clients require privacy and discretion.

We agree to treat client information confidentially, including:

  • Personal information

  • Household information

  • Travel details

  • Lifestyle preferences

  • Financial details related to service execution

Information will not be disclosed except:

  • When required by law

  • When necessary to coordinate services

  • When authorized by the client

10. Limitation of Liability

To the maximum extent permitted under applicable law, Domaine Concierge LLC shall not be liable for:

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Lost profits

  • Emotional distress

  • Loss of use

  • Property damage caused by vendors

  • Travel disruptions

  • Vendor errors

If liability is established, the Company’s maximum liability shall not exceed the amount paid by the client for the specific service involved.

11. Indemnification

Clients agree to defend, indemnify, and hold harmless Domaine Concierge LLC and its members, managers, contractors, employees, and affiliates from any claims, damages, losses, or expenses arising from:

  • Client misuse of services

  • Client instructions or decisions

  • Engagement with third-party vendors

  • Client violation of law

  • Breach of these Terms

12. Service Refusal and Client Conduct

The Company reserves the right to refuse or terminate services if a client:

  • Engages in abusive or threatening behavior

  • Requests illegal activities

  • Fails to pay invoices

  • Violates these Terms

Professional respect is required for all interactions with our team and vendors.

13. Website Use

By using the Domaine Concierge website, users agree not to:

  • Attempt unauthorized system access

  • Introduce malicious software

  • Scrape or reproduce website content

  • Use the website for unlawful purposes

Violations may result in restricted access and legal action.

14. Intellectual Property

All website content including:

  • Logos

  • Branding

  • Written content

  • Graphics

  • Service descriptions

are the property of Domaine Concierge LLC.

Unauthorized use, copying, or reproduction is prohibited.

15. Force Majeure

Domaine Concierge LLC shall not be liable for delays or failure to perform services due to circumstances beyond reasonable control, including but not limited to:

  • Natural disasters

  • Government actions

  • Vendor cancellations

  • Transportation disruptions

  • Weather conditions

  • Technology outages

16. Termination of Services

Either party may terminate services with reasonable notice unless otherwise stated in a service agreement.

The Company may terminate services immediately if:

  • Payments are overdue

  • Terms are violated

  • Safety concerns arise

Any outstanding balances remain payable.

17. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles.

18. Dispute Resolution

Before initiating legal action, both parties agree to attempt good faith negotiation to resolve disputes.

If resolution cannot be reached, disputes shall be handled through the appropriate courts located in the State of Florida.

19. Changes to Terms

Domaine Concierge LLC reserves the right to modify these Terms at any time.

Updates will be posted on this page with a revised effective date.

Continued use of services constitutes acceptance of updated Terms.
